On Wednesday, the Betting Superintendence of Brazil (SPA) announced the launch of Public Consultation Notice No. 3/2026, aiming to refine the regulations governing betting licenses in the country. This initiative seeks public input to help formulate a decree that will create updated rules for the operation of betting activities in Brazil.
This consultation is part of the SPA's Regulatory Agenda, which was established through Ordinance No. 817 in April 2025. This prior ordinance hinted at a forthcoming review of the authorization procedures for betting operators, expected to take place in the first quarter of this year. Now, with the consultation finally available online, stakeholders are invited to provide their feedback.
The purpose of this public consultation is to enhance the authorization request process, as referenced in SPA/MF Ordinance No. 827/2024. The SPA intends to integrate the insights gained from the initial authorization cycle into the forthcoming guidelines. Ordinance 827 previously detailed the stipulations regarding the rules and conditions for securing licenses to operate betting establishments.
This consultation invites contributions and information to assist the government in revising the ordinance governing the authorization of sports betting and online gaming operations. Open for 45 days, from July 27 to September 9, it allows any individual or legal entity to participate via the Portal Brasil Participativo. Interested parties must log in using their gov.br account to submit their input.
After the consultation period concludes, the SPA will analyze all submissions, in compliance with Article 31 of Decree No. 12,002/2024.
This initiative to refine licensing procedures for betting comes at a time when Brazil is emphasizing the need for increased transparency in the process. In June, Finance Minister Dario Durigan announced that the Ministry of Finance would release over 25,000 documents related to betting licensing, in line with the government’s commitment to transparency. Earlier this week, the Ministry issued Administrative Order No. 2,126, which creates a task force to ensure clarity in the licensing processes for gambling companies.
