The Brazilian betting regulator, known as the SPA, has initiated Public Consultation Notice No. 3/2026, aimed at refining the country's betting licensing regulations. Launched on Wednesday, this consultation invites public input to inform a new decree that will set forth updated rules for authorizing betting operations in Brazil.
This initiative is part of the SPA's broader Regulatory Agenda, established by Ordinance No. 817 in April 2025, which had anticipated a review of the authorization process for betting operators early this year. The consultation process is now underway, allowing stakeholders to contribute their perspectives.
The SPA's objective is to enhance the authorization request procedure as detailed in SPA/MF Ordinance No. 827/2024, which governs the approval of new betting establishments. The insights collected will be instrumental in revising these rules based on experiences from the initial authorization cycle.
The consultation period runs for 45 days, commencing on July 27 and concluding on September 9. Individuals and organizations interested in participating can do so via the Portal Brasil Participativo, using their gov.br accounts to submit their contributions.
Following the close of the consultation, the SPA will assess the feedback in accordance with Article 31 of Decree No. 12,002/2024.
This move to enhance licensing procedures coincides with increasing demands for greater transparency in the process. In June, Brazilian Finance Minister Dario Durigan revealed plans to publish more than 25,000 documents concerning betting licensing as part of a governmental pledge to uphold transparency. Additionally, earlier this week, the Ministry of Finance introduced Administrative Order No. 2,126, which establishes a task force dedicated to ensuring transparency in the licensing of gambling companies.
