The SPA, Brazil's betting regulatory authority, announced the initiation of Public Consultation Notice No. 3/2026 on Wednesday, aimed at enhancing the regulations surrounding betting licensing in the country. This public consultation seeks to gather feedback and data to inform a forthcoming decree that will set forth new rules for granting licenses for betting operations in Brazil.
This initiative is part of the SPA's Regulatory Agenda, which was established under Ordinance No. 817 in April 2025, signaling a planned reassessment of the licensing procedures for betting operators during the first quarter of the year. However, the SPA has only recently made the consultation available online.
The primary goal of this consultation is to refine the authorization process described in SPA/MF Ordinance No. 827/2024. The SPA plans to integrate insights from the inaugural licensing cycle into the revisions. Ordinance 827 delineated the conditions and regulations governing the authorization for betting establishments.
The window for public contributions will remain open for 45 days, from July 27 to September 9. Individuals and legal entities can take part by visiting the Portal Brasil Participativo. Participants must log in using a gov.br address to submit their feedback.
After the consultation period concludes, the SPA will review the submissions in accordance with Article 31 of Decree No. 12,002/2024.
This consultation comes at a time when there is a heightened emphasis on transparency within the licensing process. In June, Brazil's Finance Minister Dario Durigan stated that the ministry would release over 25,000 documents regarding betting licensing, underscoring the government's commitment to transparency.
Earlier this week, the Ministry of Finance issued Administrative Order No. 2,126, which established a task force dedicated to ensuring transparency in the licensing processes pertaining to gambling companies.
