The SPA, Brazil's betting regulator, announced the launch of Public Consultation Notice No. 3/2026 on Wednesday, aiming to enhance the current betting licensing regulations. This public consultation is designed to gather feedback and insights that will help in drafting a decree to establish new guidelines for the authorization of betting operations in the country.
This initiative aligns with the SPA Regulatory Agenda set forth in Ordinance No. 817 from April 2025, which envisioned a review of the licensing procedures for betting operators within the first quarter of this year. The SPA has only now made this consultation available online.
The goal is to refine the authorization request procedures per SPA/MF Ordinance No. 827/2024. This ordinance previously set regulations regarding the rules and conditions related to obtaining licenses for operating betting establishments. The new consultation will include insights gained from the initial licensing cycle to enhance the process.
This public consultation for input will last for 45 days, starting from July 27 and concluding on September 9. Both individuals and legal entities can participate by accessing the Portal Brasil Participativo, requiring them to use their gov.br email addresses.
After the consultation period ends, the SPA will evaluate the submissions as per Article 31 of Decree No. 12,002/2024.
This push for refining the licensing process comes at a time when there is a strong emphasis on transparency in the betting authorization process. In June, Brazil's Finance Minister Dario Durigan announced plans for the ministry to release over 25,000 documents relating to betting licensing, reinforcing the government’s commitment to transparency in this sector. Furthermore, earlier this week, the Ministry of Finance enacted Administrative Order No. 2,126, which establishes a task force dedicated to ensuring transparency in the licensing processes for gambling companies.
