On Wednesday, the SPA, Brazil's betting regulator, released Public Consultation Notice No. 3/2026, initiating efforts to enhance its betting licensing regulations. The public consultation seeks input to aid in the development of a new decree that will set forth updated rules for authorizing betting operations in Brazil.
This initiative is part of the SPA Regulatory Agenda, which was established via Ordinance No. 817 in April 2025, highlighting the need to reevaluate the authorization procedures for betting operators in the early months of this year. Now, the SPA has made the consultation available online to facilitate this review.
The aim of this public consultation is to refine the authorization request process as defined in SPA/MF Ordinance No. 827/2024. Insights gained from the first authorization cycle will be integrated into the forthcoming document. This ordinance addressed aspects of the betting laws, specifically the rules and conditions necessary for obtaining permission to run betting establishments.
The SPA will gather contributions and information during this consultation to support the revision of the ordinance governing the authorization of sports betting and online gaming operations.
Participants can engage in the consultation, which runs from July 27 to September 9, for a total of 45 days. Individuals and legal entities are invited to contribute via the Portal Brasil Participativo, and participation requires access through a gov.br account.
Following the conclusion of the contribution period, the SPA will review all submissions in accordance with Article 31 of Decree No. 12,002/2024.
This consultation on licensing improvements is taking place alongside ongoing efforts to promote transparency in the authorization process. In June, Finance Minister Dario Durigan announced that the ministry would release over 25,000 documents related to betting licensing to uphold the government’s commitment to transparency. Recently, the Ministry of Finance also issued Administrative Order No. 2,126, which establishes a task force dedicated to ensuring transparency in licensing procedures for gambling companies.
