Illinois has taken a significant step in public health by amending its laws to address gambling disorders alongside substance abuse. On July 24, Governor JB Pritzker signed Senate Bill 2749, which updates the state’s Substance Use Disorder Act to include gambling disorders in its strategy for tackling addiction.
The legislation underscores the seriousness of this issue, stating, "Substance use and gambling disorders, as defined in this Act, constitute a serious public health problem." It emphasizes the necessity of a coordinated approach aimed at prevention, early intervention, treatment, and recovery support, empowering individuals suffering from these disorders and their families to achieve healthier lives.
Highlighting the similarities between gambling and drug abuse, the bill notes that both activate similar reward systems in the brain and can lead to comparable behavioral issues affecting personal, family, and professional life.
To facilitate this new focus, the Illinois Department of Human Services is tasked with several important responsibilities, which include coordinating a statewide strategy for addressing both substance use and gambling disorders. This strategy will involve collaboration between state and federal agencies and local service providers. Additionally, the department will work with the State Board of Education to create prevention programs and resources for schools across the state.
Further measures will encompass the development of regulations and best practices to support publicly and privately funded programs involved in prevention and treatment services, alongside expanding the state’s network of gambling-related support services. This includes customer screening, crisis intervention, and public awareness campaigns aimed at educating the public about gambling disorders.
Significantly, every licensed gambling operator in Illinois, including online sportsbooks, will need to feature a finalized statement on their platforms detailing how individuals can seek help for gambling disorders.
The bill clarifies the definition of gambling to encompass a broad range of activities, including those outside of the Illinois Gaming Board's regulation, indicating an awareness of the growing issues surrounding unregulated and offshore gambling options available to residents.
The Illinois Gaming Board has a history of addressing unauthorized gambling, having issued cease-and-desist orders to unlicensed platforms, and is currently engaged in legal disputes with Kalshi and the Commodity Futures Trading Commission regarding event contracts.
This legislative change coincides with a period of evolution in Illinois' gambling market, including newly imposed taxes on licensed sportsbooks and on prediction markets. A recent budget approved by Pritzker included these measures as well as the recognition of daily fantasy sports as regulated gambling. However, attempts to legalize online casino gaming faced setbacks this year, despite efforts by legislators to advance similar proposals.
