Brazil Senate Advances Legislation for Stricter Betting Advertisement Rules

Brazil’s Senate is moving forward with legislation aimed at imposing stricter regulations on the advertising of betting products while prioritizing player safety. On September 2, 2023, the Senate’s Science and Technology Committee approved Bill PL 2,470/2026, urging for a swift examination of the proposal.

This new legislation seeks to ban advertisements for betting and online gaming across all media channels, including television, radio, print, outdoor media, streaming platforms, podcasts, the internet, and social media. Additionally, it prohibits direct advertising and behavioral marketing techniques.

Under this proposed law, all bonuses and promotions related to betting products will be banned. This includes free gambling offers, cashbacks, free spins, and loyalty programs, as well as any sponsorships tied to sports, events, athletes, or influencers.

The legislation mandates age verification for users and introduces voluntary limits on players' total spending and gambling duration. It also allows individuals to self-exclude from gambling activities with all licensed operators.

Moreover, betting operators will be prohibited from targeting self-excluded players or any vulnerable groups and cannot offer any betting products to these individuals, even with extensions.

As the bill progresses through the Senate, it stands to significantly alter how licensed betting operators in Brazil can advertise and interact with their customers.
