The Brazilian Sports Authority (SPA), which oversees betting regulations in the country, has issued Public Consultation Notice No. 3/2026, calling for input on new betting licensing regulations. This initiative aims to gather contributions and insights that will inform a forthcoming decree establishing updated rules for the operation of betting in Brazil.
This consultation is part of the SPA's Regulatory Agenda outlined in Ordinance No. 817, released in April 2025, which had previously anticipated a review of the licensing process for betting operators during the first quarter of this year. The SPA has now made the consultation available online.
The primary objective of this public consultation is to enhance the authorisation application process described in SPA/MF Ordinance No. 827/2024. The SPA intends to integrate feedback and lessons from the initial authorisation cycle into the revised document. Ordinance No. 827 set the conditions and regulations for operators seeking approval to run betting establishments.
Open to all individuals and legal entities, the consultation period will last 45 days, from July 27 to September 9. Participants can submit their contributions through the Portal Brasil Participativo. To access the portal, users must log in with their gov.br credentials.
Once the period for contributions concludes, the SPA will evaluate the submissions in accordance with Article 31 of Decree No. 12,002/2024. This move toward public consultation reflects a broader initiative for increased transparency in the licensing process.
In a related effort to promote transparency, Brazil's Finance Minister Dario Durigan announced in June that over 25,000 documents pertaining to betting licensing will be made publicly available. This step aligns with the government's commitment to openness. Additionally, the Ministry of Finance recently issued Administrative Order No. 2,126, which establishes a task force dedicated to ensuring clear licensing processes for gambling firms.
