The Brazilian regulator for betting, known as the SPA, issued Public Consultation Notice No. 3/2026 on Wednesday to enhance regulations concerning betting licensing. This consultation aims to gather feedback and insights that will inform a new decree aimed at establishing updated rules for authorizing betting operations in Brazil.
This initiative aligns with the SPA Regulatory Agenda, which was set forth by Ordinance No. 817 in April 2025, outlining plans for a review of the authorization process for betting operators in the first quarter of this year. As of now, the SPA has made this consultation available online, enabling stakeholders to contribute to refining the process.
The main goal of this public consultation is to improve the authorization request procedure as stated in SPA/MF Ordinance No. 827/2024. The SPA intends to incorporate insights gained from the initial authorization cycle into the updated regulations. Ordinance 827 laid down the groundwork for the conditions and requirements necessary for acquiring authorization to run betting establishments in the country.
The consultation process will run for 45 days, starting from July 27 and concluding on September 9. Individuals and legal entities interested in participating can do so through the Portal Brasil Participativo. Interested parties must log in using their gov.br credentials to submit their contributions.
Post consultation, the SPA will evaluate the submitted feedback, following the guidelines outlined in Article 31 of Decree No. 12,002/2024.
This move to consult the public on licensing improvements emphasizes a growing demand for greater transparency in the authorisation processes surrounding betting. In June, Brazilian Finance Minister Dario Durigan stated that the ministry would release more than 25,000 documents concerning betting licensing to bolster transparency commitments. Additionally, just this week, the Ministry of Finance enacted Administrative Order No. 2,126, which establishes a task force dedicated to ensuring clarity in the licensing procedures for gambling companies.
