On Wednesday, Brazil's betting regulator, the SPA, announced the opening of Public Consultation Notice No. 3/2026 as part of its initiative to enhance betting licensing regulations. This public consultation seeks input and information aimed at drafting a decree that will introduce new guidelines for authorizing betting operations within Brazil.
This effort is included in the SPA Regulatory Agenda established by Ordinance No. 817 in April 2025, which called for a review of the authorization procedures for betting operators to occur in the first quarter of this year. The SPA has now made this consultation available online for public contributions.
The primary focus of the consultation is to refine the authorization request process, as outlined in SPA/MF Ordinance No. 827/2024. In crafting the new guidelines, the SPA plans to incorporate insights gained from the initial authorization cycle. Ordinance 827 detailed the rules and criteria necessary for obtaining permits to operate betting establishments.
The consultation is designed to gather contributions that will assist the government in revising the ordinance governing the authorization of sports betting and online gaming operations. The consultation period will run for 45 days, from July 27 to September 9, allowing both individuals and legal entities to participate via the Portal Brasil Participativo. Participants will need to log into the portal using their gov.br credentials.
Upon the conclusion of the contribution period, the SPA will review all submissions in accordance with Article 31 of Decree No. 12,002/2024.
