The Brazilian regulator for betting, known as the SPA, has initiated Public Consultation Notice No. 3/2026, released on Wednesday, which focuses on refining regulations for betting licenses.
This consultation is designed to gather public input and insights to aid in the formulation of a decree that will set new guidelines for the authorization of betting operations in Brazil.
This initiative is part of the SPA's Regulatory Agenda, introduced by Ordinance No. 817 in April 2025. It outlined plans for reviewing the authorization process for betting operators, with an expectation for this revision to occur in the first quarter of this year.
Only now has the SPA made the consultation available online. Its goal is to enhance the authorization request process as specified in SPA/MF Ordinance No. 827/2024. This ordinance regulates various aspects of the betting laws, detailing the rules and requirements for obtaining authorization to operate betting facilities.
The current public consultation aims to collect insights and information that will help the government in updating the ordinance regarding the rules for authorizing sports betting and online gaming operations. The consultation period will run for 45 days, starting from July 27 and ending on September 9. Both individuals and legal entities are invited to take part via the Portal Brasil Participativo, requiring access through a gov.br email.
Once the contribution period concludes, the SPA will evaluate the inputs, following the guidelines outlined in Article 31 of Decree No. 12,002/2024.
The launch of this consultation comes at a time when there is increased emphasis on transparency within the licensing process. In June, Finance Minister Dario Durigan confirmed that the ministry planned to publish over 25,000 documents related to betting licensing. He highlighted that this move is in line with the government's commitment to enhance transparency.
Additionally, earlier this week, the Ministry of Finance issued Administrative Order No. 2,126 to establish a task force dedicated to ensuring transparency within the licensing procedures for gambling companies.
