Brazil Begins Public Consultation on Betting Licensing Regulations

The Brazilian regulator responsible for betting, known as the SPA, announced on Wednesday the launch of Public Consultation Notice No. 3/2026 aimed at enhancing the regulations for betting licensing.
This consultation seeks public input to inform a new decree that will set forth rules for authorizing betting operations in Brazil.
This initiative is part of the SPA Regulatory Agenda, which was established by Ordinance No. 817 in April 2025, and anticipated a review of the licensing procedures for betting operators during the first quarter of this year.
Now, the SPA has finally made this consultation available online.
The focus of this public consultation is to refine the authorization request process as detailed in SPA/MF Ordinance No. 827/2024. The SPA intends to integrate insights from the initial authorization cycle into the forthcoming document. Ordinance 827 previously established regulations surrounding the conditions and requirements for obtaining authorization to operate betting establishments.
The consultation will help collect contributions and information that will assist the government in updating the rules governing the authorization of sports betting and online gaming operations.
The public consultation will be open for 45 days, beginning on July 27 and concluding on September 9. Both individuals and legal entities are invited to participate via the Portal Brasil Participativo, requiring access through their gov.br accounts.
After the consultation period ends, the SPA will review the submitted contributions, as per Article 31 of Decree No. 12,002/2024.
This push for improved licensing procedures coincides with a broader emphasis on enhancing transparency in the authorisation process.
In June, Brazil's Finance Minister Dario Durigan announced that the ministry would release more than 25,000 documents related to betting licensing, reflecting the government's commitment to transparency.
Earlier this week, the Ministry of Finance issued Administrative Order No. 2,126, which establishes a task force focused on ensuring transparency in the licensing processes for gambling companies.
