The SPA, Brazil's betting regulator, announced on Wednesday the launch of Public Consultation Notice No. 3/2026 as part of its efforts to refine the licensing regulations for betting operations. This public consultation is an opportunity for stakeholders to provide input and information that will assist in the formulation of a new decree aimed at establishing updated rules for the authorization of betting activities in Brazil.
This initiative aligns with the SPA Regulatory Agenda set forth in Ordinance No. 817 in April 2025, which anticipated a review of the authorization process for betting operators in the first quarter of this year. However, the SPA has only now made the consultation available online.
The key goal of this public consultation is to enhance the authorization application process, as outlined in SPA/MF Ordinance No. 827/2024. The SPA intends to integrate insights gained from the initial authorization cycle into the forthcoming documentation. Ordinance 827 provided regulatory guidelines concerning the rules and conditions that operators must meet to secure authorization for betting establishments.
The consultation period will span 45 days, from July 27 to September 9, allowing both individuals and legal entities to submit their contributions through the Portal Brasil Participativo. Participants must log in using their gov.br address to engage in the consultation.
Upon concluding the contribution window, the SPA will analyze all submissions, following the procedures set out in Article 31 of Decree No. 12,002/2024.
This consultation arrives at a time when there is an increased emphasis on enhancing transparency in the licensing process. In June, Brazil's Finance Minister Dario Durigan declared a commitment to transparency by announcing the publication of over 25,000 documents related to betting licensing. This initiative underscores the government's dedication to improving transparency.
Additionally, earlier this week, the Ministry of Finance issued Administrative Order No. 2,126, which formed a task force to ensure transparency in the licensing operations for gambling companies.
