A recent lawsuit against the game developer Evolution alleges discriminatory hiring practices that favor young, attractive white women. Marlio Escobar, a former Talent Acquisition Manager hired in 2021 in Philadelphia, claims he faced harassment after bringing these concerns to light prior to his dismissal.
Escobar asserts that he first recognized the discriminatory practices in February 2023, stating that management rejected viable candidates based on age, race, ethnicity, and sexual orientation. He reports that a supervisor suggested focusing on “young, attractive, white female applicants with no children, particularly college students.”
In March 2023, Escobar reported these discriminatory practices to the HR director, submitting “extensive evidence,” which included hundreds of video recordings of interviews that allegedly showed clear bias against candidates based on their protected characteristics.
According to the lawsuit, Evolution dismissed numerous qualified applicants solely due to these biases. After Escobar voiced his concerns, he claims management intensified directives to exclude those not fitting their preferred profile.
Concurrently, an investigative firm, BlackCube, was documenting Evolution's management, suggesting that executives may have been knowingly facilitating services to illegal markets.
Following his complaint about the discriminatory hiring policy, Escobar states he endured harassment and a hostile work environment. His employment was terminated in May 2023 under the pretext of poor performance; however, he contends he never received any prior warnings or disciplinary actions.
In July 2023, Escobar lodged a Charge of Discrimination with the U.S. Equal Employment Opportunity Commission and the Pennsylvania Human Relations Commission, and subsequently received a Notice of Right to Sue Letter.
The lawsuit, filed in the Eastern District of Pennsylvania, requests compensation for lost wages, along with reimbursement for emotional distress and damage to Escobar's reputation due to the alleged discriminatory practices.
Escobar is not alone in alleging workplace discrimination; another lawsuit from earlier this year claims racial discrimination at the Mount Airy Casino Resort, where former employee Adam Stoerrle reported being demeaned for his race and faced harassment after raising these issues. Additionally, a separate lawsuit against Caesars Palace alleges that Felton Davis, an African-American employee, was dismissed based on his race.
