Stake to Challenge Overturned Injunction Against Brazil Betting Ban

Stake plans to pursue additional legal recourse after a Brazilian court overturned an injunction that temporarily shielded the operator from a ban on betting. The ban, enacted by President Luiz Inácio Lula da Silva in late September, had initially been paused thanks to a preliminary injunction allowing Stake to keep operating until October 25. However, this reprieve was short-lived. The next day, Judge Luis Antonio Johonsom di Salvo, who presides over the Federal Regional Court of the 3rd Region (TRF-3), suspended the injunction, reestablishing the ban on Stake.

The legal team at Bichara e Motta Advogados is handling Stake's case. Partner Udo Seckelmann confirmed that the operator intends to challenge the recent decision. "Of course, this is not over," Seckelmann stated. "This is just one setback that happened. We are drawing up some strategies to overturn this. We’re going to challenge this decision for sure. We have two possible strategies. We’re analyzing which one would be best to file."

While Seckelmann did not disclose the exact grounds for the challenge, he emphasized the significance of the case for the broader betting sector in Brazil, which is striving to regain its legal framework. "If we get a positive decision in the next couple of days, maybe other operators will get that too," he noted. "So we know the degree of responsibility that we have for the whole industry."

Stake argues that the ban undermines the legal certainty that companies relied on when entering the Brazilian market. The hefty requirements included a BRL30 million ($6 million) license fee and a minimum financial reserve of BRL5 million, alongside the necessity for international operators like Stake to establish headquarters in Brazil. Seckelmann reaffirmed this aspect, stating, "[The] government, you regulated the market, you established all the rules, you established that based on these rules we’re going to pay you BRL30 million plus BRL5 million of financial reserve to exploit this activity that is legal and regulated. And from one moment to another, before we reach the two-year landmark of this license that would be valid for five years, you say now it’s over, that activity is prohibited."

Since the regulated market launched on January 1, 2025, the betting sector has faced challenges regarding public perception, particularly due to media coverage linking gambling with family debt. Seckelmann highlighted that this often conflates licensed operators with illegal firms, adding, "The reasoning that was raised by the federal government to issue the provisional measure was not grounded on any relevant studies. To the contrary, if you analyze what they are saying in terms of addiction and debt, you see that the regulated market was not the villain here. It was actually illegal gambling, which was growing a lot in Brazil."

The decision to overturn Stake's injunction came at the request of the Attorney General’s Office (AGU), which claimed the initial ruling provided Stake with an unfair competitive advantage. Seckelmann suggested that the AGU specifically targeted the president of the TRF-3, who typically leans toward government interests. "The AGU appealed this decision to the president of the federal tribunal, who is pro-state, pro-federal government in his politics," he explained. "They knew that if they brought this for this president to decide, he would decide in favor of them."

With the ban affecting the industry, a survey by the National Association of Games and Lotteries indicated that over 3,500 workers have lost their jobs in Brazil's betting sector since the law was enacted. Seckelmann insists that restoring the licensed sector, even partially, is crucial. Meanwhile, two major gambling trade organizations in Brazil have filed a motion with the Supreme Federal Court (STF) to challenge the ban's constitutionality. According to Seckelmann, the resolution of that constitutional challenge is unlikely to be decided until after the second round of elections on October 25.

Stake viewed the preliminary injunction as essential in protecting the company's position during this period. "We waited for the Supreme Court to make a decision, but they were not making any decisions," Seckelmann said. "We [Stake] said, ‘Okay, they are not making any decisions. Our operation is frozen. We have to terminate several contracts. We have to fire a lot of people. We’re losing money here.’ So the judge has to understand that if you take a lot of time to decide this, our operation will be over. We have a lot of losses, and this will be irreversible. We’ll not be able to reverse everything that’s happening.","seo_title":"Stake to Challenge Overturned Injunction Against Brazil Betting Ban","meta_description":"Stake plans to contest a court decision that reinstated a ban on its operations in Brazil after a previous injunction offered temporary reprieve.
