US DOI Implements Regulations for Tribal Gaming Agreements

The U.S. Department of the Interior has announced updated regulations allowing states to negotiate agreements that enable tribes to offer gambling outside their reservations. These new rules are designed to facilitate negotiations for tribes, recognizing gaming as a crucial factor in tribal economic development.

The updated regulations establish a 'hub-and-spoke' model, which has been successfully used by the Seminole Tribe in Florida. This approach permits bets placed off Indian land to be processed through trial servers, effectively granting the Seminole Tribe an online sports betting monopoly in the state.

Additionally, the regulations aim to simplify the procedure for tribes seeking approval from the DOI for their compacts with states. Changes to 25 C.F.R. Part 293 are expected to offer clearer criteria for the DOI regarding tribal deals by defining essential terms and delineating when the DOI should evaluate a compact.
