The SPA, Brazil's betting regulator, has initiated a public consultation as part of its efforts to reform betting licensing regulations. On Wednesday, the SPA released Public Consultation Notice No. 3/2026, inviting input and insights to help craft a new decree that will set forth updated rules for authorizing betting operations within the country.
This latest measure falls under the SPA Regulatory Agenda that was established by Ordinance No. 817 back in April 2025. The ordinance indicated a review of the authorization procedures for betting operators was slated for the first quarter of this year. However, the SPA has only recently moved forward by launching the online consultation.
The objective of this public consultation is to enhance the procedures for authorization requests, as determined by SPA/MF Ordinance No. 827/2024. The SPA intends to integrate feedback from the initial authorization cycle into the new regulatory framework. Ordinance 827 covered several aspects of the betting legislation, outlining the rules and conditions necessary for securing authorization to operate betting establishments.
Now, through this consultation, the SPA is seeking contributions and information that will assist in revising the ordinance concerning the operation of sports betting and online gaming.
The consultation period spans 45 days, starting from July 27 and ending on September 9. Both individuals and legal entities are eligible to participate, with submissions made through the Portal Brasil Participativo. Interested parties must log in to the portal using their gov.br credentials.
Once the public contribution period concludes, the SPA will evaluate the submissions in compliance with Article 31 of Decree No. 12,002/2024.
This initiative for improving licensing procedures is part of a broader movement towards enhancing transparency in the authorization process. In June, Dario Durigan, Brazil's Finance Minister, announced that the ministry would make available more than 25,000 documents pertaining to betting licensing to uphold the government’s commitment to transparency.
Additionally, earlier this week, the Ministry of Finance issued Administrative Order No. 2,126, which established a task force dedicated to ensuring transparency throughout the licensing processes for gambling companies.
