Brazil Regulator Launches Public Consultation on Betting Licensing Regulations

The Brazilian betting regulator, known as the SPA, announced a public consultation on Wednesday through Public Consultation Notice No. 3/2026 aimed at revising the country’s betting licensing regulations. This step is part of the SPA Regulatory Agenda, which was established by Ordinance No. 817 in April 2025, foreseeing a review of the authorization process for betting operators in the first quarter of this year.

While the consultation was only recently made available online, its goal is to improve the procedure for requesting authorizations. This is guided by the SPA/MF Ordinance No. 827/2024, which detailed the conditions under which betting establishments can be granted operational permits. The SPA aims to reflect on insights gained from the initial authorization cycle and integrate them into the upcoming regulations for sports betting and online gaming.

The public consultation will be open for 45 days, running from July 27 to September 9. Participation is open to individuals and legal entities through the Portal Brasil Participativo, requiring users to access it via their gov.br email account. After the consultation period, the SPA will evaluate all submissions in line with Article 31 of Decree No. 12,002/2024.

This move toward revising the licensing procedures comes as part of broader efforts to enhance transparency within the authorization process. In June, Brazil’s Finance Minister Dario Durigan revealed plans to publish over 25,000 documents related to betting licenses, reinforcing the government's commitment to transparency. Additionally, the Ministry of Finance recently issued Administrative Order No. 2,126, which established a task force dedicated to ensuring clarity and openness in licensing processes for gambling companies.
