This injunction bars the use of an identical brand and specifically prohibits the misuse of the domain aviator.studio along with other associated domains.
The companies affected by this ruling include Aviator Studio Limited, Aviator Studio Holding Limited, and Aviator Studio USA Limited, all of which are required to cease using branding that closely resembles Spribe's registered EU trademarks. The injunction centers on two distinct trademarks held by Spribe, which notably include a figurative trademark featuring the word "Aviator" and an accompanying airplane graphic.
The court's decision also took into account the visibility of the competing products in the market. Users searching for "Aviator" found the similar games on websites like Betsson and EuroCasino simultaneously.
In recent developments, Aviator Studio Limited acquired a B2B license from the Malta Gaming Authority, allowing it to broaden its game distribution across Malta and other EU regions.
David Natroshvili, founder of Spribe, expressed optimism about this recent progress: "This is further momentum for Spribe after several positive outcomes. We expect a UK hearing in October and will continue to protect the Aviator game globally."
The injunction issued is temporary, and the affected companies may pursue an appeal. Additionally, Spribe is required to initiate further proceedings leading to a definitive decision on the merits within 31 days of the order issued on September 1.
