Spribe has successfully obtained a temporary injunction from a Maltese court against multiple companies affiliated with Aviator Studio due to alleged infringement of its EU trademarks. The court's decision bars these companies from utilizing an identical brand and prevents them from misusing the domain aviator.studio along with related domains.
The injunction applies to Aviator Studio Limited, Aviator Studio Holding Limited, Aviator Studio USA Limited, and other associated entities, mandating these companies to cease using branding that closely resembles Spribe's registered EU trademarks.
This legal action stems from the use of two specific trademarks owned by Spribe, which include a figurative trademark featuring the word "Aviator" alongside an illustrated airplane.
The court also acknowledged the competitive landscape, noting that users searching for "Aviator" were able to view both games simultaneously on platforms such as Betsson and EuroCasino.
Aviator Studio Limited recently acquired a B2B license from the Malta Gaming Authority, allowing it to enhance its game distribution capabilities in Malta and elsewhere within the EU.
David Natroshvili, the founder of Spribe, expressed optimism, stating, "This is further momentum for Spribe after several positive outcomes. We expect a UK hearing in October and will continue to protect the Aviator game globally."
As the injunction is temporary, the affected companies retain the right to appeal. Additionally, Spribe must initiate legal proceedings regarding the merits of the case within 31 calendar days following the order issued on September 1.
