Australian Customers Launch Class Action Against Entain

A group of Australian customers from wagering companies Neds and Ladbrokes has initiated a class action lawsuit against Entain, the parent company of both brands, seeking compensation for lost live bets that they allege violate Australian legislation. Live betting in Australia is subject to several restrictions. Although customers can place bets via phone during sporting events, the law mandates that all betting information must be communicated verbally during the call. The crux of the dispute centers around Entain's use of a service known as "Fast Code." This system enables customers to select their live bets via the website or mobile app and receive a code of eligibility, which they then relay to the bookmaker during the phone call. Plaintiffs argue that essential betting information was not fully communicated in this process, thus breaching the legal requirements. In December 2023, the Australian Communications and Media Authority (ACMA) completed a year-long review, concluding that the implementation of such codes by various operators contravenes the law. According to ACMA, all betting information and confirmations must be clearly communicated within the telephone conversation. In response, Entain refutes the claims of illegality associated with their service and intends to defend its position in court. Additionally, the company has filed a counterclaim indicating that if the court rules in favor of the customers and orders reimbursements for lost bets, Entain seeks to reclaim any winnings that have already been distributed to them.
