Justice Luiz Fux of Brazil's Supreme Federal Court (STF) has unveiled the schedule and participant list for an upcoming public hearing focusing on the provisional measure that puts a ban on betting. This hearing is part of Direct Action of Unconstitutionality (ADI) 8027, which is under Fux's jurisdiction.
The court has selected 28 entities to participate, including representatives from the executive branch, various football clubs, sports organizations, associations, and institutes relevant to the subject.
Participants were required to submit the names and legal authorizations of their representatives to adi8027@stf.jus.br by 3 PM on Thursday. Each organization can appoint up to two representatives.
The hearing is set for November 3, commencing at 10 AM in the session room of the STF's Second Chamber. It will be broadcasted on TV and Radio Justiça, as well as streamed on the STF's YouTube channel. Each entity is allocated a maximum of 10 minutes to present their views regarding Provisional Measure (MP) 1.394/2026, which prohibits the operation of fixed-odds betting and mandates the termination of licenses for companies in the industry.
Notable participants include clubs such as Flamengo, Fluminense, Botafogo, Cruzeiro, São Paulo, and Corinthians. Additionally, the Brazilian Football Confederation (CBF) and the Brazilian Olympic Committee (COB) will present their opinions. Also participating are representatives from the Attorney General's Office (AGU), the Ministries of Finance and Sports, and the Prosecutor General's Office (PGR) along with the National Confederation of Commerce of Goods, Services and Tourism (CNC) and the National Confederation of Industry (CNI).
Entities representing the betting sector, including the National Association of Games and Lotteries (ANJL) and the Brazilian Institute of Responsible Gaming (IBJR), will also be present. Other organizations linked to economic freedom, broadcasting, and market regulation like the Brazilian Association for Economic Freedom (Able) and the Brazilian Association of Radio and Television Broadcasters (Abert) will contribute as well.
The ANJL filed ADI 8027, seeking an immediate suspension of Provisional Measure 1,394/2026 and a ruling on its unconstitutionality. The petition also asks the STF to affirm the existing laws governing fixed-odds betting in Brazil. Similar challenges are ongoing with ADIs 8,024, 8,028, and 8,035.
Moreover, the STF is reviewing ADIs 7721, 7723, and 7749, which question the legality of Law 14.790/2023, known as the Betting Law, which introduced regulations for this type of betting in the country. In November 2024, a prior public hearing saw participation from over 50 experts and representatives from various public and civil organizations. The AGU has since requested the court evaluate the potential for a new session, asserting that developments in the betting landscape and the enactment of the provisional measure warrant a fresh discussion.
The hearing schedule indicates that Fux will begin with 10 minutes of opening remarks, followed by presentations from football clubs, after which the CBF and COB will speak. After a lunch break, the AGU will present, followed by the finance and sports ministries. The ANJL and IBJR are on the roster to speak between 3 PM and 3:20 PM, with the International Gaming Association rounding out the presentations around 5 PM.
