Dudena will oversee Brazil gambling regulation following his appointment as SPA leader

Regis Dudena, who has been named the head of Brazil’s prize and bets secretariat, will supervise the regulation of gambling in the country.

In the Official Gazette of the Union of Brazil, the announcement was made that Dudena will assume the leadership role of the Prize and Betting Secretariat (SPA) as of January 1, 2019. Rui Costa, the chief of staff for Brazil’s government, signed Dudena’s appointment.

The SPA, a body of the Ministry of Finance will organize and publish future frameworks as well as organise regulation. Before, the SPA was without a leader. Simone Vincentini served as its deputy secretary.

Dudena worked previously in the fields of public and regulatory law. Dudena has worked as legal director for the National Association of Railway Carriers.

Dudena and Dario Durigan are close colleagues. Dario is the executive secretary for Brazil’s Treasury. They worked together when Dilma was president.


Dudena’s new role as a Brazilian

Dudena will be responsible for the regulation of gambling in Brazil. After President Luiz inacio Lula Da Silva signed Bill 3,626/2023 into law in December of last year, the country is now in the process to regulate the betting market.

The SPA, in conjunction with the Brazilian Ministry of Finance published Normative Ordinance 615 last week. The new regulations stipulate that bets cannot be placed using credit cards or crypto currency.

Brazil has a plan to implement regulation in four stages, with the final stage expected by July 20, 2024. In the first stage, which is currently underway, payment, security, and technology frameworks are being implemented.

In the second phase, the SPA will publish its fraud policies including strategies against money laundering and counterterrorism financing. Third phase will be centered on the procedures for advertising, as well as technology and security. The last phase will focus on the ways in which the industry can support socially-responsible causes.


Ads for sports betting to fall under Ministry of Finance regulations

In April, it was announced that advertising for sports betting in Brazil must comply with regulations set by the Ministry of Finance.

In the 2024 edition, Brazil Football Confederation (CBF’s) General Competition Regulations specifies advertising guidelines. Illegal operators are prohibited from advertising.

Advertising that makes unsubstantiated statements about the likelihood of winning is also prohibited, along with marketing which promotes gambling as an answer to financial problems or as socially acceptable pastime.

The operators are prohibited from using celebrities and other influential people to promote gambling products.
