Australian customers of Neds and Ladbrokes, gambling brands operated by Entain, have initiated a class action lawsuit seeking compensation for lost live bets, alleging that these practices violate Australian law.
Live betting regulations in Australia impose several restrictions. While bettors can place wagers over the phone after sporting events have commenced, the law mandates that all betting information be conveyed during the phone call.
The controversy stems from the method by which these bets were processed. Entain employs a system called "Fast Code," which allows customers to select their live bets via a website or app and then relay the eligibility code to a bookmaker over the phone. The plaintiffs contend that this approach lacks some critical betting information, thereby failing to meet legal requirements.
In December 2023, following a comprehensive review, the Australian Communications and Media Authority (ACMA) determined that the practices of multiple operators, including Entain, breached the law. The regulator emphasized that all bet information and confirmations must be fully communicated during the telephone conversations.
Entain has refuted claims of illegality, preparing to defend its service in court. Additionally, the company has filed a counterclaim, asserting that should the court order compensation for the plaintiffs, it seeks to reclaim any winnings previously distributed to them.
