Customers of Neds and Ladbrokes, both gambling companies in Australia, have initiated a class action lawsuit against their parent operator, Entain. The lawsuit seeks compensation for live bets that the customers argue are not in compliance with Australian regulations. In Australia, live betting is subject to various restrictions. Although bettors can place wagers after a sporting event has commenced via phone, the regulations stipulate that all betting information must be communicated during the call itself.
The contention in this case revolves around the method of placing the bets. Entain employs a system known as "Fast Code," which enables users to select their live bets through the website or app and then transfer the eligibility code generated by the system to the bookmaker while on the phone. The lawsuit's plaintiffs contend that crucial betting information has been left out, which they argue means the legal requirements are not being met.
In December 2023, following a comprehensive year-long review, the Australian Communications and Media Authority (ACMA) determined that several operators, including Entain, had breached legal standards by using such codes. The ACMA noted that both the betting information and confirmation must be conveyed completely during the telephone conversation. In response, Entain has rejected the assertion that their service is unlawful and intends to defend its position in court. Additionally, the company has filed a counterclaim asserting that if the court orders reimbursement for customers' lost bets, Entain seeks to recover any winnings that have already been paid out to those customers.
