Station Casinos' request to the U.S. Supreme Court for a temporary hold on a lower court's order has been denied. On September 4, Chief Justice John Roberts turned down the emergency request for a stay. As a result, Red Rock Casino is now required to adhere to the National Labor Relations Board's ruling, which includes recognizing the Culinary Union and engaging in bargaining with it.
Back in December 2019, employees at Station Casinos' Red Rock Casino Resort voted against unionizing. The Culinary Union alleged that Station Casinos manipulated the election outcome by enhancing employee benefits just before the vote.
The National Labor Relations Board sided with the Culinary Union, concluding that the actions of Station Casinos influenced the election results. Consequently, despite the initial rejection of unionization by the employees, Red Rock Casino must now acknowledge the Culinary Union and commence negotiations.
In response, Station Casinos issued a statement expressing their disappointment, stating, "The NLRB decision overturned the clear vote of Red Rock team members rejecting the Culinary Union. The decision prevents any company from granting benefits to its employees if it is aware of union interest in unionizing the company’s employees and nullifies the Red Rock team members’ vote to be union-free, all because Station Casinos treated its team members too well."
Nevertheless, this recent ruling does not mark the conclusion of the matter. Station Casinos may still ask the Court to formally consider the underlying case.
