Aviator Studio has scored a major legal victory in Brazil, as a Federal Court has ordered the suspension of Spribe's trademark registration for 'Aviator.' This ruling acknowledges the validity of Aviator Studio's claims regarding the invalidity of Spribe’s trademarks. Issued by the 18th Federal Civil Court of the Federal District, the decision bars Spribe from exercising exclusive rights linked to Brazilian trademark registration No. 501759803 until a final verdict is reached. The court's ruling follows legal action initiated by Aviator Studio Brazil, which presented evidence showing that the Aviator trademark was developed and utilized long before Spribe secured trademark rights in Brazil. The court recognized that the Aviator brand was created in Georgia in 2016 and was officially registered there in 2018, predating Spribe's Brazilian registration. Additionally, the court referred to earlier judicial decisions in Georgia that nullified Spribe’s registration of the Aviator trademark and reaffirmed the rights of its original owner.
