Dutch gambling regulator cracks down on violations of payout rules

The Dutch Gambling regulator Kansspelautoriteit has issued an order to operators that they must adhere to payout rules. This comes after 13 of them failed to comply with their license requirements.

KSA reported that a recent KSA investigation revealed nine operators were blocking payouts for customers. Another four are suspected to be doing the same. The Dutch Gambling Act states that payouts to players must be processed immediately, without any conditions.

In March 2024, the regulator reminded operators of their regulatory obligations. KSA had at the time given examples of the conditions that providers may not use. These included minimum payouts and wagering before the provider can pay back.

The 13 providers are required to confirm, in writing, that no minimum withdrawal amount or any other requirement is imposed.

KSA stated in a press release: “An operator cannot impose conditions structurally that would prevent direct payments. The KSA must refund player credits without delay. The KSA does receive signals from online gambling providers that they do place conditions on payment of credits.

The Dutch Gambling Act and payouts

According to the Gambling Act, all licensees are required to ensure that payments are processed securely and player credit is distributed. According to the legislation, the gambling account must be debited in favour of the player at the time the credit is requested.

Michel Groothuizen, the chairman of KSA in July, praised operators who adhered to all new regulations imposed by regulators. This was especially true during this summer’s UEFA Euro 2024. He stated that the vast majority of licensed operators adhered to the existing rules.

Groothuizen stated: “We asked gambling operators to display their best sides and yes, they did. This did require that the laws and regulations were closely followed. “Almost no legal operators have crossed the line.”
