Swish Analytics has taken legal action in California’s Superior Court against OddsJam and OpticOdds, citing claims of “Hot News” misappropriation, restitution, unjust enrichment and unfair competition.

Swish claims that the defendants’ operations heavily rely on the unauthorized use of its proprietary odds data, sourced from sportsbooks and other platforms. The defendants allegedly republish and sell this information while attempting to compete with Swish by providing sportsbooks and other clients access to Swish’s proprietary data, taken from its sportsbook partners, to undercut its business. Swish estimates the damages caused to exceed $100 million, potentially far more.

Licensed operators such as FanDuel and bet365 work with Swish, which provides odds for key sports leagues like the NFL, NBA, and NHL. Also, Altenar recently expanded its partnership with Swish Analytics, introducing micro-betting and fast market options for Major League Baseball.

Swish submitted evidence, including screenshots, accusing OpticOdds of replicating its proprietary odds.

Swish mentioned:

The companies knowingly accessed the computers, computer systems, or computer networks of Swish’s licensees in order to take, copy and make use of Swish’s proprietary odds information without permission.

Ryan Weinstock, the CCO of OpticOdds, mentioned:

One of the company’s main goals was to scale our marketing efforts and expand our team to help emerging sportsbooks compete with industry leaders.
